Terms of Purchase

The eWood.lv online shop is run by SIA DEURO, reg. No. 50103415601, legal address: Kurzemes pr. 48-56, Rīga, LV-1067 (the Seller). Phone +371 29568256, e-mail info@ewood.lv. Warehouse: Vējstūru iela 3, Rīga. By placing an order the buyer confirms having read and accepted these terms.

In these terms a consumer is a natural person who buys goods for a purpose unrelated to his or her business or professional activity. Companies and persons buying for business purposes are not consumers, and consumer rights (including the right of withdrawal) do not apply to them.

1. Order and contract

The buyer chooses the product, size and quantity; the calculator shows the price. Once the order is placed the buyer receives an invoice. The contract is concluded when the invoice has been paid in full. If the invoice is not paid while it is valid, the Seller may cancel the order and release the reserved delivery time.

If, exceptionally, the ordered goods cannot be supplied, the Seller informs the buyer and refunds the payment received.

2. Prices

Prices are in euros. For private persons prices are shown including VAT. For companies registered as VAT payers the reverse charge applies to timber supplies under Section 141 of the Latvian Value Added Tax Law, so no VAT amount is added to the invoice. The price stated in the invoice applies if the invoice is paid on time.

3. Payment

Orders are paid by bank transfer against the invoice, quoting the invoice number. The invoice is valid for 24 hours from the time it is issued. The goods are prepared and handed over after full payment has been received.

4. Pickup and delivery

Goods can be collected from the warehouse (Vējstūru iela 3, Rīga) or delivered with the Seller's transport. The site calculates the delivery price from the distance to the address and shows it before the order is confirmed (see Delivery). The buyer chooses the delivery day and time when ordering.

The buyer ensures that a truck can reach the stated place (hard surface, sufficient width and room to manoeuvre) and that someone accepts the goods at the stated time. Goods are unloaded next to the vehicle; carrying and stacking further is not included in the delivery price. If delivery is impossible for reasons on the buyer's side (no access, nobody to accept the goods), a repeated delivery is charged according to the delivery calculator.

On receipt the buyer checks the quantity and visible condition of the goods and signs the waybill. The risk of accidental loss or damage passes to the buyer on handover.

5. Properties of the goods

Wood is a natural material. Knots, differences in colour and grain, resin pockets and small drying cracks are natural properties of wood, not a defect. Fresh-sawn timber has natural moisture: as it dries it shrinks and may warp or crack slightly; if stored incorrectly (without spacers and ventilation) blue stain may appear. After receipt, timber must therefore be stored in a dry, ventilated place on spacers.

The dimensions of sawn timber are subject to the tolerances usual in the trade. Weights shown on the site are approximate. Photographs are illustrative.

6. Right of withdrawal (consumers only)

A consumer may withdraw from the contract within 14 days of receiving the goods without giving a reason. To do so, use the page Withdraw from the contract or send a statement to info@ewood.lv (the form at the end of these terms may be used).

There is no right of withdrawal for goods made to the consumer's specifications — this applies to non-standard sizes sawn to order ("Made to order" in the calculator).

Returning the goods. The consumer brings the goods back to the warehouse (Vējstūru iela 3, Rīga) within 14 days of sending the statement. The consumer bears the cost of returning the goods. Because of their size and weight, timber and fuel cannot normally be returned by post; if the consumer wants the Seller's transport to collect the goods, this costs the same as delivery to that address according to the delivery calculator.

Condition of the goods. Returned goods must be unused, undamaged, and in the same quantity and condition as received. The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics — for example if they have been sawn, treated, built in, soaked, soiled or stored in unsuitable conditions. In that case the refund is reduced by the loss in value.

Refund. The Seller refunds the amount paid by the consumer, including the delivery cost, no later than 14 days from the day the withdrawal statement is received, by transfer to the account from which payment was made. The Seller may withhold the refund until the goods have been received back.

7. Claims for non-conformity

A consumer has the legal right to make a claim for goods not in conformity with the contract within two years of receiving the goods. Claims are made by writing to info@ewood.lv with the invoice number; please attach photographs. The natural properties of wood described in section 5, and changes caused by incorrect storage or use after receipt, are not a lack of conformity.

For companies: claims about quantity and visible defects must be made on receipt (noted on the waybill), and about other defects within 5 working days of receipt. The Seller's liability does not exceed the value of the goods concerned.

8. Liability

The Seller is not liable for non-performance or delay caused by circumstances beyond its control (force majeure, road closures, weather, vehicle breakdown and the like). In such a case the delivery time is agreed anew.

9. Personal data

The Seller processes the buyer's data in accordance with the Privacy Policy.

10. Disputes

The contract is governed by the law of the Republic of Latvia. Disputes are settled by negotiation. If no agreement is reached, a consumer may turn to the Consumer Rights Protection Centre of Latvia (www.ptac.gov.lv); disputes are heard by the courts of the Republic of Latvia.
